Cohesity disposes of six-patent litigation brought by adverse competitor Commvault

Jones Day successfully represented Cohesity Inc. ("Cohesity") and obtained dismissal in a six-patent, competitor suit filed by Commvault Systems in April 21, 2020. The case implicated several technologies relating to data management and data backup systems and functionality. Through two years of litigation, Jones Day developed strong prior art and an inequitable conduct defense based on Commvault's own products, filed two inter partes review petitions (obtaining institution of IPR proceedings on both), and obtained dismissal of several asserted claims through multiple claim construction proceedings. In the middle of its IPO, Cohesity was able to resolve the dispute with Commvault, thereafter obtaining dismissal.
