IU Health secures a big win in provider monopolization action

Jones Day represented Indiana University Health, Inc. (IU Health) in an antitrust, defamation, and breach-of-contract action commenced by a former independent medical staff physician, Dr. Ricardo Vasquez. Vasquez alleged an unlawful monopoly designed to exclude independent physicians from participating in the market for specialty physician services. Jones Day obtained summary judgment and a dismissal with prejudice on all claims against IU Health. Faced with a motion for an award of millions of dollars in fees and costs, Vasquez agreed to pay IU Health a portion of its fees and agreed to a press release in which he acknowledged his conduct.
