Medical device company prevails in ICC arbitration brought by equipment supplier

Jones Day successfully defended a Silicon Valley medical device company against claims brought against it by a supplier of radiation equipment components. The medical device company had entered into an exclusive agreement with the supplier for manufacture of certain cutting-edge radiological components. When the manufacturer supplied several defective units, the medical device company cancelled the supply arrangement. The U.S. manufacturer brought an ICC arbitration asserting breach of the supply contract and seeking significant damages. After further proceedings, including Jones Day’s submission of a detailed and highly-persuasive responsive case, the manufacturer agreed to abandon its claims and settle on a walk-away basis.
