Salvadoran woman fleeing domestic violence obtains remand to Board of Immigration Appeals

Jones Day recently obtained a remand of a Board of Immigration Appeals (BIA) decision upholding a final order of removal against Amalia de Jesus Gomez-Arriola. Jones Day was appointed to represent the client pro bono on appeal to the Ninth Circuit and filed a brief before the court. Jones Day argued that the Board misapplied Ninth Circuit and BIA precedents and failed to conduct a rigorous analysis of petitioner’s proposed particular social group in its decision rejecting her asylum claim. The Government then voluntarily sought remand to the BIA.
