Vietnam veteran secures remand in Court of Veterans Appeals and application for attorneys' fees and expenses granted
Client(s) Client W.G.
Jones Day successfully represented a Vietnam veteran in his appeal to the U.S. Court of Veterans Appeals (CAVC) following denial of medical benefits for serious conditions associated with exposure to agent orange during service. The Department of Veteran's Affairs (VA) had denied the claim for benefits on various grounds and the Board of Veterans' Appeals (Board) affirmed that denial. On appeal, Jones Day secured a stipulated remand on the grounds that the Board provided an inadequate statement of reasons or bases. On June 5, 2024, the CAVC granted the Firm's unopposed motion for attorneys' fees and expenses.
