Baptist Memorial Health Care defends nurse compensation antitrust class action

Jones Day represented Baptist Memorial Health Care in the defense of an antitrust class action lawsuit alleging its involvement in a conspiracy with competing hospitals to suppress nurse compensation. After defeating class certification on the grounds that the named plaintiffs were inadequate class representatives, we successfully defended on appeal the denial of an application of another individual to intervene in the litigation. In 2013, the two original plaintiffs voluntarily dismissed their claims. We also defeated in the district court the post-judgment attempts of two other individuals to intervene in the case and are now defending those favorable rulings in the court of appeals.
