R.J. Reynolds secures dismissal of smoking and health case

Jones Day client R.J. Reynolds Tobacco Company secured a dismissal of an individual smoking and health case pending in the U.S. District Court of South Carolina. The Court granted Reynolds' motion to dismiss plaintiff's complaint on all but one ground. The Court dismissed the plaintiff's negligence and strict liability claims on the ground that cigarettes are not unreasonably dangerous under South Carolina law because cigarette packages carry a warning that is deemed adequate as a matter of law to warn the customers of the dangers.
