The Shale Energy Revolution: A Lawyer's Guide, coauthor, edited by Barclay Nicholson & Sarah Casey, American Bar Association

Jones Day partners Roy A. Powell and Basheer Y. Ghorayeb and associates Kevin C. Meacham and Michael A. Magee co-authored The Shale Energy Revolution: a Lawyer’s Guide, published by the American Bar Association (ABA) Section of Litigation’s Energy Litigation committee. Along with Robert Lang of Navigant, the Jones Day lawyers authored the third chapter of this four-chapter book.

The chapter includes a detailed review of common contractual disputes and litigation trends with a specific focus on the issues surrounding royalty disputes, pooling and unitization disputes, and implied covenants disputes. These three types of disputes commonly arise in connection with conventional oil and gas activities, generating a large body of legal precedent on key issues. Similar disputes may arise in the context of leases in shale plays and many of the legal issues created by horizontal drilling have yet to be resolved by the courts. The chapter highlights unique legal issues posed by horizontal drilling in shale for oil and gas.
