Cooper Industries resolves liability insurance dispute over contaminated ground water

Jones Day represented Cooper Industries and its affiliate Cooper B-Line, involved the allocation of amounts paid in settlement of two wrongful death claims filed against the two Cooper entities, one of which was covered by the relevant policy and the other which was not covered. Jones Day persuaded the Fifth Circuit to reverse the trial court's summary judgment, which allocated the entire disputed amount to the non-covered entity, and to remand for further proceedings.
