Saturn Distribution obtains dismissal of appeal and multiple requests for temporary restraining order
Client(s) Saturn Distribution Corporation
Jones Day represented Saturn Distribution Corporation in a proceeding filed by a dealership, Lou Sobh Saturn, Inc., which objected to the alleged opening of a Saturn dealership within 10 miles of the protesting dealer's location. After the dealership filed an administrative action, Jones Day successfully argued that the plaintiff lacked standing. After the agency agreed, the plaintiff filed a purported appeal and multiple motions for temporary restraining order. The reviewing court dismissed the appeal, accepting Saturn Distribution Corporation's argument that the appeal was not timely filed. The Court also denied plaintiff's motion for leave to amend and denied a separate motion for reconsideration.
