Student successfully defends against school officer's allegations of criminal mischief

Jones Day attorneys assisted in quashing criminal charges for an eighth grade middle school student in connection with a school disciplinary matter. A school police officer alleged the student had caused less than $50 in damage to a school bathroom and issued the student a criminal citation.
Texas Appleseed referred the case to Jones Day. Texas Appleseed is a Texas-based organization that researches and reports on the impact of school discipline policies; ticketing, arrest and use of force in public schools; and court involvement in student discipline. Jones Day accepted this representation to help prevent a simple school disciplinary matter from following this student for the rest of his life in the form of a criminal conviction.
After Jones Day attorneys conducted discovery, interviewed witnesses, and prepared various pretrial motions, the city attorney elected to quash the charges prior to the jury trial.
