Twelve Beverage obtains permanent injunction against continued trademark infringement

Jones Day represented Twelve Beverage, LLC, a beverage manufacturer, in a trademark infringement case brought by Barnie's II, Inc. in the Middle District of Florida. Barnie's sought declaratory judgment that its unauthorized use of Twelve Beverage's "PRONTO" trademark in connection with the sale of coffee-based beverages did not constitute trademark infringement or unfair competition. On April 14, 2014, the Court entered a final judgment in favor of Twelve Beverage permanently enjoining Barnie's from any use of the trademark "PRONTO."
