Indivior prevails in wrongful death action relating to its prescription addiction maintenance drug Suboxone

Jones Day obtained the dismissal of wrongful death claims on behalf of Indivior Inc. that were filed in New York federal court by the estate of a patient who was prescribed Indivior's prescription maintenance drug Suboxone and later took a heroin overdose. The plaintiffs' complaint alleged failure-to-warn and design-defect claims and sought $100 million in damages. In an August 9, 2018, order, the district court first granted Indivior's motion arguing that the venue in New York was improper and then, in exercising its discretion to determine whether to transfer or dismiss, dismissed the action because the action was time-barred under applicable Connecticut law.
