Spirit Airlines wins arbitration over pilot pay

Jones Day client Spirit Airlines, Inc. prevailed in an arbitration regarding the circumstances under which pilots are entitled to additional pay while being held at the airport for possible rescheduling. The Air Line Pilots Association, International ("ALPA"), the labor union which represents Spirit's pilots, argued that the pay was owed whenever a pilot was not formally notified of a rescheduling or possible rescheduling until after arriving at what would have otherwise been the pilot's final destination. The arbitrator rejected this argument, agreeing with Spirit that the pay is owed only when there is uncertainty as to whether a pilot will be rescheduled, and not when a rescheduling decision is made and the pilot's schedule is modified before the pilot reaches the airport.
