U.S. Steel prevails in litigation over alleged contract breaches
Client(s) United States Steel Corporation
Jones Day client United States Steel Corporation prevailed in a lawsuit brought by its long-time construction and demolition contractor, Allied Erecting and Dismantling. Allied sought $41 million in damages for alleged contract breaches related to its work at U. S. Steel plants over a ten-year period. Following a successful mid-trial Daubert challenge to Allied's damages expert, the court granted U. S. Steel's directed verdict motion on Allied's most significant claims. At the conclusion of the three-week trial, the jury awarded Allied $1.6 million, while U. S. Steel had previously won summary judgment on a $10 million counterclaim against Allied.
