FirstEnergy reaches agreement to resolve Department of Justice investigation

Jones Day represented FirstEnergy Corp., an Akron, Ohio-based public utility holding company, in connection with negotiating a Deferred Prosecution Agreement ("DPA") with the DOJ to resolve the DOJ's investigation into FirstEnergy. The settlement included favorable terms for FirstEnergy, allowing the company to build on meaningful actions it had already taken to enhance its compliance program, strengthen its leadership team, and implement more robust oversight of its governmental affairs engagement. As noted in the DPA, FirstEnergy provided substantial cooperation with the investigation, including conducting a thorough internal investigation; proactively identifying issues and facts that would likely be of interest to the government; sharing information that would not have been otherwise available to the government; and making such material available to the government on an expedited basis.
