Experian obtains directed verdict at trial involving claims under Fair Credit Reporting Act
Client(s) Experian Information Solutions, Inc.
Jones Day represented Experian Information Solutions, Inc. and obtained a directed verdict after plaintiff rested his case. The case involved allegations that Experian violated 15 U.S.C. 1681e(b) and caused plaintiff significant emotional distress. After two days of testimony, plaintiff rested his case. Experian moved for a directed verdict arguing that plaintiff had not shown the sort of severe emotional distress required under the law to recover for negligence. The court agreed, granted the motion, and dismissed the case with prejudice.
