Donte Parrish argues before U.S. Supreme Court that certain premature notices of appeal become effective when appeal period begins to run

Client(s) Parrish, Donte

Jones Day represented Donte Parrish in the U.S. Supreme Court in a case presenting a question about notices of appeal that is particularly important to pro se incarcerated litigants. Mr. Parrish filed a notice of appeal before the district court granted his motion to reopen the appeal period. The United States agreed that his notice was sufficient. Nevertheless, the Fourth Circuit held that Mr. Parrish had lost his right to appeal by failing to file a second notice of appeal within the 14-day reopening period. Jones Day helped Mr. Parrish convince the Supreme Court to grant certiorari and briefed and argued the case on the merits.
