Laura Jane Durfee is a trial lawyer who represents clients in civil and criminal litigation and regulatory and compliance matters involving the health care industry. Laura Jane represents health care providers, device manufactures, and other health care entities in matters involving allegations of health care fraud and abuse, including matters relating to the False Claims Act (FCA), Anti-Kickback Statute (AKS), Stark Law, Medicare and Medicaid reimbursement, and state and federal regulations. She also has experience litigating complex contract and business disputes and product liability claims.
Laura Jane has significant experience conducting government and internal investigations. Her recent representations include conducting an internal investigation for a manufacturer relating to compliance with the AKS in connection with discounting and sales and marketing practices; defending health care providers in an FCA case, where the allegations focused on medical necessity; and representing a national pharmacy in nationwide litigation relating to opioid dispensing practices. She is also a member of a Jones Day team that defends a national laboratory in professional negligence litigation across the country.
Laura Jane maintains an active trial and appellate pro bono practice. Through Jones Day's association with a local city attorney office, she served as a municipal prosecutor and successfully prosecuted several cases before judges and juries. On the appellate side, Laura Jane has briefed cases before the U.S. Supreme Court; U.S. Courts of Appeals for the Second, Fifth, and Sixth Circuits; and several Texas appellate courts. She also has argued before the Sixth Circuit.
