GM obtains dismissal of case by dealer alleging coercive acts and bad faith

Jones Day represented General Motors Corporation when plaintiff filed an action against General Motors Corporation and GMAC seeking damages for the "entire" lost "value" of plaintiff's business operations. Plaintiff claimed to operate a dealership business exceeding $50 million in revenues. Plaintiff alleged "coercive acts" and "bad faith" in connection with the loss of plaintiff's new motor vehicle dealership operations. Jones Day represented GM in defense of the action. GM and GMAC filed motions to dismiss and the Court heard argument, after which the Court granted the motions to dismiss in their entirety on February 26, 2007. Plaintiff then moved to amend the complaint, which the Court denied in an opinion dated March 22, 2007. On appeal, the United States Court of Appeals for the Fourth Circuit affirmed the district court's dismissal in a decision dated November 15, 2007.
