Alameda Health System prevails on grievance regarding independent contractor status of anesthesiologists.

Client(s) Alameda Health System

Jones Day client Alameda Health System ("AHS") prevailed in a grievance filed by a class of anesthesiologists seeking status as employees instead of as independent contractors. The anesthesiologists were petitioning to be classified as employees rather than independent contractors and to be included in the Union of American Physicians and Dentists bargaining unit at AHS. Following a hearing and a post-hearing briefing, the arbitrator determined that the anesthesiologists were properly classified as independent contractors, and therefore could not be included in the bargaining unit.
