CSXT wins summary judgment against race discrimination and retaliation claims

Jones Day obtained summary judgment on behalf of CSX Transportation, Inc. against race discrimination and retaliation claims brought by a former locomotive engineer. The Court dismissed the matter stating the Plaintiff could not establish the elements of his claims and that the defendant terminated him for misconduct, not in retaliation for reporting the alleged discriminatory or retaliatory behavior.
