Jones Day advised a major American manufacturer during the COVID-19 pandemic on obtaining immunity from liability for the manufacture and distribution of covered countermeasures under the Public Readiness and Emergency Preparedness Act (PREP Act). That advice included successfully assisting with obtaining emergency use authorizations from the Food & Drug Administration and counseling the client regarding the Secretary of Health & Human Services's February 4, 2020 PREP Act declaration.
