Jones Day represents Abercrombie & Fitch Co. in a lawsuit filed against its commercial landlord Simon Property Group and more than 60 of Simon's lessor affiliates, seeking the return of rent payments made during the COVID-19 pandemic. Abercrombie paid the rent under threat of lease default, and is reserving its rights pursuant to dozens of commercial lease agreements.
