Daiichi Sankyo affiliate defends against declaratory judgment action in collaboration dispute

On behalf of Daiichi Sankyo Europe GmbH ("DSE"), Jones Day successfully defended and resolved a pharmaceutical collaboration dispute filed in federal court in the Southern District of New York. Plaintiff Esperion Therapeutics, Inc. sought an expedited declaratory judgment about whether it had satisfied certain requirements of a contingent $300 million regulatory milestone payment in the parties' license agreement following the completion of a cardiovascular outcome study. DSE opposed the request for declaratory relief on the grounds that Esperion had not satisfied certain requirements for the regulatory milestone payment.
