GM obtains dismissal of all claims in dealership lawsuit

Jones Day obtained a Rule 12(b)(6) dismissal of a lawsuit against General Motors Corporation in the Eastern District of New York. The plaintiff claimed that GM had promised that the plaintiff dealership would be awarded an additional linemake and also claimed that the plaintiff was made unprofitable because it was a stand-alone GMC dealership without other GM linemakes. The plaintiff brought various statutory claims and other claims against GM, including a constructive termination and breach of good faith claim. The Court dismissed all of the claims in favor of GM. No appeal was filed.
