Abercrombie defeats putative class action under California's UCL and CLRA

Jones Day defended Abercrombie & Fitch in a case alleging that Abercrombie's gift card redemption policies violated California's Unfair Competition Law and Consumer Legal Remedies Act. Plaintiff sought to represent a class of all California consumers in possession of an Abercrombie gift card. She alleged that Abercrombie had a practice of refusing to redeem gift cards for cash that had less than $10 in value remaining. Abercrombie argued that its practices complied with California law and that the plaintiff lacked the necessary injury to support standing. The trial court granted Abercrombie's demurrer and dismissed the case.
