Procter & Gamble wins summary judgment of infringement and no invalidity in Tooth Whitening Strip patent dispute

Jones Day represented The Procter & Gamble Company in patent infringement litigation asserting three of P&G's patents relating to tooth whitening products and methods. P&G brought suit against three infringers to protect its incredibly successful Crest Whitestrips® line of products. After defeating a motion to transfer, and two motions to stay pending inter partes review, Jones Day won a complete sweep of all claim construction disputes. Subsequently, the Court granted P&G summary judgment of infringement and summary judgment of no invalidity of all asserted claims of all three patents. Thus, the Firm obtained judgment of liability on all three asserted patents without a trial.
