Experian resolves putative class action over misuse of sensitive credit data by debt relief business

Jones Day represented Experian Information Solutions, Inc. in a putative data privacy class action brought by consumers alleging that Experian failed to take proper precautions to safeguard their personal credit data from an individual in Florida who had engaged in a massive fraud. The named plaintiffs in the lawsuit specifically alleged that the Florida man used sensitive credit data purchased from Experian to mail consumers advertisements for his debt relief business. Experian exposed the fraud and defended the robustness of its procedures and the case was resolved following briefing on class certification and on Experian's motion for summary judgment. A class was not certified by the court.
