Lincoln Electric responds to COVID-19

Jones Day advised Lincoln Electric regarding compliance with government orders around the world regulating essential businesses and business activities during the COVID-19 pandemic. The Jones Day team also provided counsel regarding development of a series of regulators for bulk oxygen support to individual ventilators, coverage of an existing ventilator under an Emergency Use Authorization, a request for coverage to the Food and Drug Administration, and the extent of PREP Act coverage. The team provided analysis and explanation of CARES Act provisions regarding device shortage reporting with respect to individual regulator and Powered Air Purifying Respirators (PAPRs). The team also advised the welding company, designated as an essential business under the applicable state executive order, regarding anticipated response to and compliance with the county’s investigation into a “cluster” of COVID-positive individuals at the facility, including compliance with applicable county, state, and federal guidelines on safe business practices.
