Brown & Williamson obtains dismissal with prejudice following grant of bifurcated trial on limitations defense

Jones Day obtained a dismissal with prejudice from plaintiff shortly before trial for Brown & Williamson Tobacco Corporation in a long running product liability case pending in the Central District of California. Key to the dismissal was obtaining a ruling from the trial court in November 2009 granting their request for a separate, early trial of their client Brown & Williamson's statute of limitations defense. This dismissal for our client follows earlier successful defense summary judgment motions gaining dismissal with prejudice of plaintiff's unfair competition and false advertising claims under California's Section 17200/17500.
