Advanced Graphics reaches settlement in breach of contract suit

Jones Day client Advanced Graphics Technologies, Inc. reached a settlement with seven defendants after 20 months of litigation in Texas state court. In June 2013, Advanced Graphics filed suit for breach of contract in Bexar County, Texas after counter-parties to a settlement agreement failed to uphold their promise to pay remediation expenses associated with a former chrome plating facility in Tarrant County, Texas operated by the defendants or their predecessors-in-interest for more than 20 years. Because the counter-parties to the settlement agreement were dissolved or merged into other entities, Advanced Graphics filed suit against seven related entities, alleging that they were liable for the debt under alter ego and various other theories of liability. Jones Day immediately implemented a strategy to prepare the record for summary judgment and the case for trial, which led to the matter being settled.
