Major non-profit health system successfully defends against discrimination charges

Jones Day successfully defended a major non-profit health system against two separate charges submitted to the U.S. Department of Labor, Office of Federal Contract Compliance Programs (OFCCP) alleging discrimination on the basis of race and sex and retaliation. The OFCCP found that the investigations did not substantiate the complainants' allegations of discrimination or retaliation. In one matter, the agency also found that several of the incidents alleged occurred more than 180 days before the complaint was filed and as such, OFCCP lacked jurisdiction but that in any event, there was no evidence to substantiate any unlawful conduct based on race.
