HD Supply secures early dismissal from NPE patent infringement case

Jones Day secured an early dismissal for HD Supply, Inc. in a patent infringement case involving interactive web page technology. The case was filed by serial patent litigant and non-practicing entity Tangelo IP, LLC and was assigned to Judge Rodney Gilstrap. In January 2016, Jones Day filed a motion to dismiss the case, arguing that the claims of the asserted patent were directed to ineligible subject matter under 28 USC s. 101 and the Supreme Court's Alice decision. Three months later, Tangelo agreed to dismiss the case, prior to the court's decision on the motion to dismiss, without any payment from HD Supply to the plaintiff.
