Jones Day obtained summary judgment on behalf of Memorial Sloan Kettering Cancer Center dismissing a discrimination action by a former medical technician. The employee alleged that the defendants discriminated against him on the basis of ethnicity, race, and gender in violation of New York Executive Law and New York City Human Rights Law. The plaintiff's theory was that his supervisor favored plaintiff's minority-race and ethnicity co-workers, and counseled and disciplined plaintiff while not similarly treating his co-workers, ultimately leading to the termination of plaintiff's employment. The Court found that plaintiff's claim failed because he could not establish that defendants' actions were motivated in any way by discriminatory animus, and it dismissed the complaint in its entirety.
