Company successfully obtains dismissal of TCPA "junk fax" class action

On behalf of a company, Jones Day obtained the dismissal of a Telephone Consumer Protection Act ("TCPA") class action. The class action complaint alleged that Jones Day's client adopted and implemented "an illegal junk fax advertising program to promote the sale of its property, goods and services." After Jones Day moved to bifurcate discovery to limit discovery to the named plaintiff company's claims or threshold issues, the plaintiff company dismissed the action with prejudice. No payment was made to the plaintiff company or its counsel in connection with the dismissal.
