Applied Medical Distribution obtains favorable result following seven-week jury trial
Client(s) Applied Medical Resources Corporation
Following a seven-week jury trial, Jones Day assisted its client, Applied Medical Distribution Corporation, in securing a jury verdict that found misappropriation of trade secrets against a former high ranking executive of Applied as well as his new employer. In addition, the jury found that the former employee breached his contracts with Applied. Following the jury verdict, Applied secured a permanent injunction enjoining the individual and his new employer from using or disclosing its trade secrets, and requiring remediation efforts to ensure Applied's trade secrets were permanently purged from all electronic systems and devices. Thereafter, Applied moved for entry of judgment as well as for an award of attorneys’ fees and costs as against is former executive. On September 14, 2022, the court entered judgment in favor of Applied against its former employee on the company’s trade secret misappropriation claim, incorporated the terms of the permanent injunction into the judgment against that former executive, and awarded the Company $553,905 in fees and costs.
