Jones Day represented a Fortune 10 company in putative class action and qui tam lawsuits brought by third party payor health and welfare plans. After the trial court dismissed both lawsuits with prejudice, the court of appeals reversed, holding that the complaints satisfied heightened pleading standards. The state Supreme Court agreed to review the consolidated cases and, in an unanimous decision, reversed the court of appeals' ruling and reinstated the trial court's dismissals. Siding with Jones Day's client, the court concluded that the complaints failed to plead any of the claims with the requisite particularity. As a result, both lawsuits are dismissed with prejudice.
