TalentWise defends against preliminary injunction involving non-competition agreement

Jones Day successfully defended TalentWise Solutions LLC ("TalentWise") and its employee in a preliminary injunction matter seeking to enforce a purported non-competition agreement to prevent the employee from working for TalentWise. The plaintiff corporation brought claims for breach of contract against the employee and tortious interference with that contract against TalentWise, requesting injunctive relief and unspecified compensatory damages. TalentWise opposed the plaintiff's motion for a preliminary injunction and appeared before Judge Rakoff for a preliminary injunction hearing. The court denied the plaintiff's request for a preliminary injunction and dissolved the TRO that previously had been granted ex parte. Following the favorable preliminary injunction decision, TalentWise moved to compel the plaintiff to arbitrate its claims against the employee and moved to stay the case against TalentWise pending arbitration. At oral argument, Judge Rakoff granted both of the client's motions. After very limited discovery in an arbitration administered by the American Arbitration Association, the parties agreed to a confidential settlement. Following the parties' execution of a settlement agreement, the court dismissed the action with prejudice and the AAA closed the arbitration.
