Los Angeles County successfully defends against FEHA age and disability discrimination suit

Jones Day obtained a demurrer without leave to amend as to all causes of action in a suit alleging Los Angeles County engaged in age and disability discrimination in violation of California's Fair Employment and Housing Act. The suit was brought by former officers of the now-defunct Los Angeles County Office of Public Safety who were offered non-sworn positions with the Los Angeles Sheriff's Department when their department was eliminated and they failed to meet the hiring criteria for deputy sheriff positions. The court found that legislative immunity barred claims for damages, and that none of the plaintiffs had pleaded the required elements of an intentional disability discrimination claim.
