Procter & Gamble successfully protects Crest Whitestrips® line of products
Client(s) Procter & Gamble Company, The
Jones Day represented The Procter & Gamble Company in securing a consent judgment and permanent injunction against a private label manufacturer infringing P&G's patents and the trade dress packaging and trademarks for its successful Crest Whitestrips® line of products. On P&G's behalf, Jones Day asserted infringement claims against two defendants and sought preliminary injunctive relief. One defendant settled immediately and agreed to respect P&G's intellectual property and remove its products from the market. After a preliminary injunction hearing, during which the Court indicated that it was going to grant P&G's motion for preliminary injunction, the remaining defendant agreed to enter into a consent judgment and permanent injunction, which the Court subsequently entered. This case is yet another in a line of successful cases that Jones Day has brought on behalf of P&G regarding infringement of P&G's tooth whitening intellectual property by private label manufacturers.
