President Biden's Executive Order on Promoting Competition in the American Economy tasks federal agencies with setting policies "[t]o avoid the potential for anticompetitive extension of market power beyond the scope of granted patents" and to ensure that the patent system does not "unjustifiably delay generic drug and biosimilar competition."
Responses from the agencies have included the following:
- A policy statement from the Federal Trade Commission regarding Orange Book listings; and
- A collaboration initiative between the U.S. Food and Drug Administration and the U.S. Patent and Trademark Office.
In addition, the Inflation Reduction Act (IRA) seeks to lower prescription drug costs for Medicare patients through, e.g., biosimilar and generic competition or reduced prices for drugs without such competition.

This program has been approved for 1.00 hour of general credit by the State Bar of California and 1.00 hour of areas of professional practice credit (including transitional credit) by the New York State CLE Board.
