Memorial Sloan-Kettering wins dismissal of national origin discrimination and retaliation claims at Second Circuit

Jones Day obtained dismissal of a former employee's discrimination and retaliation claims on behalf of Memorial Sloan-Kettering Cancer Center. The former employee claimed that Memorial Sloan Kettering discriminated against her on the basis of her national origin and retaliated against her under Title VII of the Civil Rights Act of 1964. The district court found that the former employee's claims must be dismissed because she had failed to exhaust the administrative remedies required by Title VII prior to bringing suit. The former employee appealed to the Second Circuit, where the district court's decision was affirmed in its entirety.
