Health system resolves False Claims Act qui tam lawsuit

Jones Day represented a health system in a qui tam action brought by a former physician employee alleging violations of the federal and Indiana False Claims Acts. The claims were premised on allegations of improper billing, retaliatory discharge, and violation of the federal Anti-Kickback Statute relating to the support of Federally Qualified Health Clinics. Jones Day obtained initial dismissal as to the Anti-Kickback and retaliatory-discharge claims. Relator filed a second amended complaint on May 5, 2016, which dropped the retaliation claims, but attempted to re-plead the Anti-Kickback claims. Our client filed a second Motion to Dismiss on June 20, 2016. The parties reached a final settlement on April 27, 2017. The Court dismissed the case on May 4, 2017.
