Jones Day advised a large digital health company in expanding operations throughout multiple states in the U.S. and in responding to several state regulator inquiries regarding its operations. The company enables physicians, nurse practitioners, and physician assistants to engage with patients remotely through the use of telemedicine. Jones Day advised the company with respect to a host of telehealth regulatory and transactional matters including cross-state formation and licensure requirements, patient consents, professional corporation affiliations, corporate practice of medicine prohibitions, and the supervision and delegation requirements for the use of non-physician providers.
