SAP America resolves allegations of trade secret misappropriation by competitor

Jones Day defended SAP America, Inc. in a trade secret case brought by Paragon Data Systems in the Cuyahoga County Court of Common Pleas in Cleveland, Ohio. Paragon accused SAP and SAP's customer, Cintas, of misappropriating trade secrets involving software used to manage Cintas stockrooms. Paragon had sought significant damages. Based on a claim of equitable estoppel, SAP argued, and the Court agreed, that a limitation on liability in the supply agreement between Cintas and Paragon applied to SAP, even though SAP was not a signatory to the agreement. The parties successfully resolved the matter through settlement shortly thereafter.
