CNX wins summary judgment in post-M&A indemnification lawsuit against CONSOL Energy

Jones Day recently obtained summary judgment on behalf of CNX Resources Corporation ("CNX") in a post-M&A indemnification lawsuit against CONSOL Energy, Inc. ("CONSOL"). The suit arose after Jones Day represented CNX in the successful settlement of a pension plan's multi-billion dollar ERISA claim, and CONSOL refused to indemnify CNX against that claim under the terms of the parties’ 2017 spin-off agreement. Judge Vivian Medinilla granted CNX’s motion for partial summary judgment, holding that CONSOL is liable to fully indemnify CNX.
