California Applicant Privacy Notice

Day (the “Firm”, “us”, “our”, or “we”) is committed to protecting the personal information of its employment applicants residing in the State of California (hereinafter, “you” or “Applicants”). This California Applicant Privacy Notice (“Notice”) explains the personal information we collect about you depending on the position for which you are being considered, the sources from which we collect your personal information, the purposes for which we collect it, how and why we disclose your personal information, in each case during the prior twelve month period.  This Notice also explains your privacy rights under the California Consumer Privacy Act, as amended by the California Privacy Rights Act of 2020 (the “CCPA”) related to our use of your personal information.  This Notice only applies to you if you reside in the State of California at the start and during the application process.

1. What Personal Information About Applicants We Collect
The Firm may collect the following categories of personal information from you directly or about you from other sources which may vary based on the position for which you are being considered:

  • Personal Details and Identifiers: This includes your name, personal contact details (i.e., physical address, e-mail address, telephone numbers), and similar information as permitted by applicable law. Geolocation Data. This includes your geographic location when using our online application portal and to the extent you visit our physical locations (e.g., through our internal badging and physical security system(s).
  • Professional or Employment-related Information. This includes current or past employment history, job title, conflicts of interest information, personal references, awards and recognitions, and references related to your previous employment.
  • Non-public Education Information. This includes education records about you maintained by an educational institution or party acting on its behalf, including grades, transcripts, schedules, honors and awards, recognitions, educational and student activities, and student ID numbers.
  • Experienced (Lateral) Partner Information. For lateral partner positions, this includes information related to current and former client representations, financial data (hours, billings, collections), legal claims, professional conduct, ethics, legal malpractice, legal and regulatory violations, conflicts of interest, financial obligations and insurance.
  • Network and Applications Data: This includes data required to access our network, systems, and applications we make available to you for access during the application process, as well as information that we collect through your use of our information technology resources that is reasonably linked to you.

2. Sources from Where We Collect Your Personal Information

  • Directly from you: We collect information that you share with us directly when you apply to a position with us, complete paperwork during the application process, or when you otherwise interact with us and provide personal information in the context of your application and during our processing and our communications to you concerning your application.
  • From services providers and third parties: When you apply to a position with us, we may collect information about you from our service providers with whom you provide your personal information, such as recruiters and third-party referrals.
  • From publicly available sources:  We also receive information about you from publicly available sources, such as public websites and government records. 

3. The Purposes for Which We Use Your Personal Information

The Firm will use your personal information for our business purposes, including the following purposes:

  • Job Applications: To process your job application you submit to us, to make employment or offer decisions, to establish your relationship with the Firm, and, if applicable, to proceed with a job offer, where applicable. 
  • Business Operations: To manage our business, which includes managing, recruiting, human resource administration, product and service development, tax reporting and filings, strategic planning, maintaining records relating to business activities, and operating and managing Technology Support Services (TSS) and communications systems and facilities.
  • Monitoring and Compliance: To comply and monitor compliance with internal policies, applicable laws and regulations, and ethical and client requirements including background checks through a third party provider, where appliable.
  • Communications: To facilitate communication with you, ensure business continuity and crisis management, to protect the health and safety of personnel and others, and to safeguard and maintain our property.

4. How and Why We Disclose Your Personal Information

We disclose certain of your personal information to third parties that provide services to us or to you directly on behalf of the Firm, as further described below and where necessary for the provision of the contracted services. We impose contractual restrictions on these third parties’ use of your personal information, including imposing non-disclosure, confidentiality, and security of your information when it is processed to provide the contracted services. 

  • Administrative and Legal Reasons: We may transfer and disclose your information, including personal information, to third parties: (i) to respond to subpoenas or other legal process or if in our opinion such disclosure is required by law; (ii) to conduct background checks, where applicable (iii) at the request of governmental authorities conducting an investigation; or (iv) to protect the personal safety, rights, property or security of any individual and the Firm.
  • Business Transfer: We may disclose personal information with our affiliated offices for internal reasons. We also reserve the right to disclose and transfer all information including, without limitation, your personal information in connection with a corporate merger, consolidation, restructuring, the sale of substantially all of the Firm’s assets or other corporate change, including, without limitation, during the course of any due diligence process.
  • Professional Financial and Legal Advisors: We may need to disclose personal information with our professional advisors, which includes lawyers, auditors, bankers, or other professional consultants for business purposes.

5. Retention of Your Personal Information

We will not retain your personal information for longer than is allowed by applicable law, the Firm document retention obligations, and client requirements. This means that your personal information will be used as necessary for establishing, performing, and terminating the partnership or employment relationship with the Firm and to comply with legal and client requirements.  

6. Notice of Collection from Individuals Under 16 Years of Age

We do not collect information directly from individuals under the age of 16.


7. Notice of Sale and Sharing under CCPA

We do not “sell” or “share” (as these terms are defined by the CCPA) your personal information. We do not collect your sensitive personal information for the purpose of inferring characteristics about you.


8. Your California Privacy Rights

As a California resident, you have the following privacy rights you can exercise in connection with our use of your personal information, subject to certain legal exemptions and restrictions.  You can exercise your privacy rights by sending an email to privacy@jonesday.com or by calling 1-888-404-1150.

  • Right to Know:  You have the right to know about the categories of personal information we collect about you, the sources from which it is collected, purpose for which it is collected, and to whom it is disclosed.  This information is already disclosed in this notice.  In addition, under the right to know, you also have the right to know about the specific pieces of personal information we have collected about you.  If you would like to know about the specific pieces of personal information we have collected about you, please contact us.  
  • Right to Correct:  You have the right to correct any inaccurate personal information we have about you. 
  • Right to Delete:  You have the right to ask us to delete your personal information.  If we are unable to delete your personal information, we will provide you with an explanation.    
  • Right to Non-Discrimination:  We will not discriminate against you for exercising any of your privacy rights, including those under California law. 

Please note that for certain requests we may ask you, or your agent making a request on your behalf, for identity verification information and permissions in a manner permitted by the CCPA.  If you would like to authorize another person to make a request on your behalf, please direct them to the contact information above. The Firm will only accept requests from your third-party agents in a manner that complies with the CCPA.
