Javier Gutiérrez has more than 14 years of experience counseling domestic and international clients in all types of matters related to Spanish labor and employment law.
Javier has significant experience advising on a wide range of matters including labor aspects arising from cross-border transactions, complex litigation, reorganizations (particularly under TUPE [Transfer of Undertakings (Protection of Employment) Regulations] schemes), restructuring and temporary layoffs, dismissals based on disciplinary and business grounds, collective negotiations, and incentive schemes. He also represents clients on the negotiation and drafting of agreements for senior management and key positions, including senior executive contracts, noncompete covenants, and separation agreements. Additionally, he assists on privacy and data protection matters within the framework of employment relations, including the drafting and implementation of employees' compliance protocols, monitoring of work-related IT systems, and video surveillance at workplaces.
Javier has developed specific sector knowledge, having advised clients operating in industries such as life sciences and health care (Cardinal Health, Curium, Mallinckrodt Pharmaceuticals, and Merz Pharma), technology (Ansys, Blackberry, and Verizon), retail (Coach/Stuart Weitzman), and industrial and automotive (Ferro, General Electric, and International Automotive Components).
Javier regularly advises NGOs as an active member of Jones Day's pro bono practice. He has lectured as a professor at Centro de Estudios Garrigues and ISDE and is a member of Foro Español de Laboralistas (FORELAB), a leading association of Spanish labor lawyers.
