Abbott wins defense verdict in first pharmaceutical products liability trial involving Lupron

Jones Day successfully defended Abbott Laboratories ("Abbott") in a pharmaceutical products liability trial before a jury in federal court in Las Vegas involving the prescription drug, Lupron Depot 3.75 mg ("Lupron"). A doctor prescribed Lupron to plaintiff at the age of 17. Alleging that the drug rendered her permanently disabled, plaintiff asserted various failure-to-warn claims and sought punitive damages against Abbott and its former joint venture, TAP Pharmaceutical Products, Inc. At the close of plaintiff's case, the judge granted Abbott and TAP judgment as a matter of law on plaintiff's punitive damages claim. Later, the jury returned a unanimous verdict for Abbott and TAP on all remaining claims.
